Terms of Service

These terms explain how you may use OfacScanner, how subscriptions and limits work, and who is responsible for what. Results support your compliance decisions, and the final decision always stays with your team.

Agreement and who we are

These terms govern your use of the OfacScanner sanctions screening service, the website at ofacscanner.com, the app and the API (together, the "service"). The service is operated by the administrator of the ofacscanner.com service ("we", "us"), reachable at [email protected]. By creating an account or using the service on behalf of an organization, you accept these terms for that organization and confirm you may bind it.

Independence from OFAC and the U.S. Treasury

OfacScanner is an independent compliance tool. It is not affiliated with, endorsed by, or connected to the Office of Foreign Assets Control or the U.S. Department of the Treasury, or to any other government body whose lists the service reads. OFAC and the names of other authorities are used only to describe the lists we screen.

What the service does

The service compares names and other details you submit with public sanctions lists published by government authorities, gives each result a score and a risk rating, stores evidence of each check and, depending on your plan, offers batch screening, ongoing monitoring, case management, webhooks, an API and payment screening. The features of each plan are described on the pricing page.

Results support your decisions

Results are an aid to your own compliance program. They do not tell you whether a transaction is legal and they are not legal advice. A Clear rating does not guarantee that a person or company is not sanctioned, for example because a name is spelled in a way no matching method can connect, because the subject is owned by a blocked person under the OFAC 50 percent rule, or because a list changed after the check. A possible match is not proof that a person is listed.

You remain responsible for reviewing each result, for your decisions and for meeting your legal obligations, including any blocking or reject reports and recordkeeping. You must not use results as the only basis for a decision that has legal or similar effects on a person without human review.

Not a consumer reporting service

We are not a consumer reporting agency and results are not consumer reports. You must not use the service to decide whether a person is eligible for credit, insurance, employment, housing or any other purpose covered by the Fair Credit Reporting Act or similar laws.

List data

We read official lists from the sources named on our sanctions lists page, check them for updates every 30 minutes and show the version used in every result. Authorities can change, delay or withdraw publications, and official files can contain errors. We do not guarantee that list data is complete or current at every moment, and we are not responsible for the content published by the authorities.

Accounts and access

You must give a valid email address, keep your password and API keys secret and tell us at once if you suspect unauthorized use. You are responsible for what users of your workspace do. Accounts are for organizations and their staff, and each person needs their own login.

Plans, billing and changes

Paid plans are subscriptions billed monthly or yearly in advance in US dollars through our payment operator. Prices are shown on the pricing page. There is no free plan. A one time demo of one screening without an account and 10 checks after signup is offered to new users and does not renew.

  • Usage. Each plan includes a number of checks per billing period. Checks are counted when they are used and deleting a screening does not return a check. Unused checks do not carry over.
  • No overage fees. When you reach your limit, new checks pause until the next period or until you move to a larger plan. Monitoring of saved records continues.
  • Upgrades to a larger plan or from monthly to yearly billing apply after you pay the prorated difference, which is charged at the time of the change.
  • Downgrades apply right away and the unused value of the current plan is credited to the next invoice.
  • Cancellation. You can cancel renewal at any time in the billing portal. Access continues to the end of the paid period. Fees already paid are not refunded, except where the law requires a refund.
  • One workspace can hold one active subscription.

Acceptable use

You may use the service only for lawful compliance, risk management and due diligence purposes. You must not resell raw list data or results as a data product, try to break or overload the service, get around plan limits, share accounts, submit data you have no right to process, or use the service to help anyone evade sanctions. We may suspend access that puts the service or other customers at risk and will tell you why.

API terms

API access is part of the Scale and Enterprise plans, and sandbox keys are available on every account. You must respect the documented rate limits, keep keys secret and verify webhook signatures. The API reference is published in the API documentation. We may change the API with reasonable notice and keep version 1 stable for existing fields.

Your data

You keep all rights in the data you submit. You give us permission to process it only to provide the service, as described in the privacy policy. For screening data we act on your behalf, and a data processing agreement is available to every paying customer. You confirm that you have a lawful basis for screening the people whose data you submit.

Our rights

The service, its software, matching methods, design and documentation belong to us. These terms give you a right to use the service during your subscription and nothing more. Public sanctions lists remain subject to the terms of the authorities that publish them.

Availability and support

We work to keep the service available at all times and announce planned maintenance in advance when possible. Enterprise includes a 99.9 percent monthly uptime commitment described in its service level terms. Support is provided by email at [email protected], with priority handling on Scale and Enterprise.

Disclaimer of warranties

To the extent the law allows, the service is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of results.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, lost profits, fines or penalties imposed on you, or decisions you make based on results. Our total liability for any claim connected with the service is limited to the fees you paid for the service in the 12 months before the event that caused the claim. Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You may stop using the service and close your account at any time. We may end these terms if you seriously breach them and do not fix the breach after notice. After closure you can export your evidence for 30 days, after which we delete workspace data as described in the privacy policy.

Changes to these terms

We may update these terms. Material changes are announced by email to account owners at least 30 days before they take effect. If you do not agree, you can cancel before the change applies.
