What is an OFAC check

An OFAC check is a search of a customer, vendor, payee or counterparty against the lists kept by the Office of Foreign Assets Control, part of the U.S. Department of the Treasury. The main list is the Specially Designated Nationals and Blocked Persons List, usually called the SDN list. It names people, companies, vessels and aircraft whose property is blocked and with whom U.S. persons generally may not do business.

The rules apply to U.S. citizens and permanent residents wherever they are, to companies organized under U.S. law and their foreign branches, and to anyone physically in the United States. Many non-U.S. companies run the same check because they pay in dollars, use U.S. banks or sell to U.S. customers who ask for it in their contracts.

OFAC liability is strict. A company can be penalized for a prohibited transaction even if nobody knew the customer was listed. That is why a quick, documented check before you onboard, ship or pay is the basic control in every sanctions program.

Is an OFAC check required by law?

The law prohibits dealing with blocked persons rather than naming a specific search. In practice a documented check is the standard way to meet that duty, and banks, payment partners and regulators expect to see it.

Which lists does an OFAC check cover?

The SDN list and the OFAC consolidated non-SDN lists, which include the Sectoral Sanctions Identifications list and the Foreign Sanctions Evaders list. On Growth and higher OfacScanner also checks the UN, EU, UK, Canadian and Australian lists.

How often should I run an OFAC check on a customer?

At onboarding and every time the lists change. Since the SDN list is updated several times a month, most teams use automatic monitoring instead of repeating checks by hand.

What do I do with a possible match?

Compare the date of birth, nationality, address and identifiers with your customer data. If they do not fit, clear it with a reason. If they fit, stop the transaction and follow your program, which may include a blocking or reject report to OFAC within 10 business days.

How long should I keep proof of OFAC checks?
